Terms of Service
These Terms describe the relationship between you and Khiip's maintainers when you visit the Khiip website at khiip.com. They are informational. They operate alongside the AGPL-3.0 LICENSE that governs your use of the Khiip software, the DISCLAIMER that describes what the software does and does not do on your behalf, and the Privacy Policy that describes what information is collected when you interact with the website.

What these Terms cover, and what they do not
These Terms cover your use of the Khiip marketing website at khiip.com, the Khiip Plus paid subscription if you choose to purchase it, and any other service that Khiip's maintainers may operate from that domain in the future. They cover the commitments below about how those services are designed and how changes to them would be communicated to you.
These Terms do not govern your use of the Khiip software itself. The software is distributed under the AGPL-3.0 license for the daemon and substrate, and the Apache-2.0 license for the SDKs. Those licenses are the legal instruments that govern what you may do with the source code and the compiled software. The DISCLAIMER is the companion document that describes what the software does and does not do; these Terms cross-reference it where relevant but do not displace it.
These Terms do not cover data handling on khiip.com. The Privacy Policy is the canonical document for that.
Who is publishing these Terms
Khiip is maintained by an individual maintainer operating as a sole proprietor. There is no company entity at v0.1.0. When these Terms say "Khiip's maintainers," they refer to that maintainer and any contributors that may be added later. References to "we" throughout these Terms mean the same thing.
If and when an entity is formed, these Terms will be revised to reflect that — see the Material changes section below for the notification mechanism.
Your agreement
By accessing or using the khiip.com website, you agree to these Terms. If you do not agree, do not use the website. Your use of the Khiip software is governed by the AGPL-3.0 license and the DISCLAIMER, not by these Terms; the Terms apply when you interact with the website itself.
These Terms are not directed at children. If you are under the age permitted by your jurisdiction's data-protection rules (13 in many places, higher elsewhere), please do not use the website. The Privacy Policy addresses minor records in more detail.
Using the website
You may browse khiip.com, follow links from it, and share links to its pages. You may quote from or reference the website in publications, reviews, blog posts, and social media as long as the source is identified. You may take screenshots and use them in reasonable commentary, education, or reporting.
The following uses are not permitted:
- Disrupting the website. Do not run denial-of-service attacks, automated traffic intended to degrade availability, or any activity intended to interfere with normal operation.
- Scraping at scale. Crawling the website at a rate that imposes meaningful load is not permitted. Reasonable indexing by mainstream search engines and reading by automated link previewers is normal use.
- Misrepresenting affiliation. Do not represent yourself as Khiip, as one of Khiip's maintainers, or as authorized to speak on Khiip's behalf unless you are.
- Circumventing security. Do not probe, test, or attempt to bypass any access controls, including those of the third-party services that host the website (see Third-party services below).
The list above is non-exhaustive — reasonable, well-behaved use is the standard.
The Khiip software
The Khiip software is distributed under the AGPL-3.0 license for the daemon and substrate, and the Apache-2.0 license for the SDKs. Your use of the software is governed by those licenses, not by these Terms. The licenses are the legal instruments; these Terms describe the website and any services Khiip's maintainers may operate. The DISCLAIMER is the companion document describing substrate behavior; the Privacy Policy is the companion document describing website data handling.
Contributions to the Khiip source code repository on GitHub are governed by
CONTRIBUTING.md in the repository, which uses the Developer
Certificate of Origin (DCO) for contribution attribution. Repository
contributions are not subject to these Terms.
Our commitments
The substance below is how Khiip is designed and how changes would be communicated. Some commitments describe v0.1.0 fact; others describe how things will work if and when Khiip introduces services or features that don't currently exist. Where a commitment is forward-conditional, we say so plainly.
Local by default
Khiip runs on your machine. Captured content is written to a local vault and
data directory you control; Khiip's maintainers do not host any captured content
at v0.1.0, because no Khiip-operated infrastructure exists for the daemon to send
to. The complete inventory of every outbound network call the daemon makes is at
docs/telemetry.md
in the project repository, and the diff history of that file is the audit trail
for any change to network behavior across versions.
If Khiip's maintainers introduce hosted services in the future that transmit your captured content, vault, recall queries, or graph relationships to Khiip-operated infrastructure, those services will require explicit per-service opt-in; you will not be enrolled silently. The local daemon and any future hosted services are not committed to feature parity — some capabilities may exist only in the self-hosted form, and some only in the hosted form, because the operational realities of each are different. Both forms will preserve the substrate-truth guarantee above: the local daemon will continue to run on your machine without requiring Khiip-operated infrastructure.
Your data, your export
Your captures live on your machine in standard, open formats — Markdown with YAML frontmatter for human-readable content, and JSON for structured payloads. There is no Khiip-controlled format to export from at v0.1.0 — the on-disk layout is the export. Schemas for typed payloads are documented in the project repository.
If Khiip's maintainers introduce hosted services in the future, export of your data from those services will remain available in the same open formats (Markdown, YAML, JSON) per documented schema. When new data structures are introduced in hosted services, export-format support will ship within 30 days of the structure being introduced.
Khiip Plus subscriptions
The Khiip daemon and substrate are free and open-source under the AGPL-3.0 LICENSE, and remain so — you never pay to read your own data. Khiip Plus is an optional paid subscription that adds enriched capture and Khiip's styled, platform-reminiscent renders. Like the free tier, Khiip Plus runs on your own machine: it is unlocked by a license key your software verifies locally, not by a hosted service.
Billing is handled by Polar. Payment, the free trial, renewals, tax, and cancellation for Khiip Plus are processed by Polar acting as the merchant of record — meaning Polar is the seller of record for the transaction and is responsible for charging your card and remitting applicable taxes. Your payment-card details are handled by Polar and its payment processor; Khiip's maintainers do not receive or store your full card number. What the maintainers receive from Polar is the information needed to provision your subscription (such as your email, country, subscription status, and an account identifier) and to issue your license key. How that information is handled is described in the Privacy Policy.
The free trial. Khiip Plus is offered with a 30-day free trial. You provide a payment method when you start, but you are not charged during the trial. Your charge date is disclosed when you sign up, and a reminder is sent before the trial converts. If you cancel before the trial ends, you are not charged. If you do not cancel, the trial converts to a paid subscription at the end of the 30 days and renews automatically for the billing period you chose (monthly or annual) until you cancel.
Cancelling. You can cancel at any time through Polar's customer portal. Cancel during the trial and you are not charged. Cancel a paid subscription and it stays active until the end of the period you have already paid for, then does not renew. When a subscription ends — by cancellation, non-renewal, or an unresolved failed payment — Khiip Plus features turn off and your software returns to the free base tier. Your captured data is not affected: your vault, your files, and everything you captured stay on your machine and remain fully readable in the free tier.
Refunds. The free trial is the primary way to decide whether Khiip Plus is worth paying for, before any charge. If you are charged and believe it was a mistake — an unintended renewal, for example — write to hello@khiip.com within 14 days of the charge and the maintainers will refund it. Other refund requests are considered in good faith.
Founding pricing. Early subscribers may be offered a "founding" price. If you subscribe at a founding price, that price is held for the life of your subscription; a later increase to the standard price applies only to new subscribers, not to you. A founding price is kept as long as your subscription stays active; it does not survive a refund.
Price changes. Any change to the price of an existing, active subscription will be communicated at least 90 days before it takes effect, and you will be able to cancel before it does. Raising the standard price for new subscribers is not a change to your price if you are on a founding or previously-agreed rate. From time to time the maintainers may offer limited-time pricing or discounts; the terms of any such offer are specified at the time of the offer and apply only to that offer's window.
AI features
All AI features at v0.1.0 are opt-in and require explicit configuration; substrate-layer AI behavior, including the relationship to local and cloud LLM providers, is documented in DISCLAIMER. Khiip's maintainers are not an AI provider; when you configure a cloud LLM endpoint, inference happens at that provider and is governed by that provider's terms.
If Khiip introduces AI features in future versions or hosted tiers, those features will not be silently enabled. New AI capabilities will ship in opt-in alert form, requiring explicit user activation before any AI processing occurs on your behalf.
Discontinuation (if and when hosted services exist)
Khiip's maintainers do not currently operate any service that holds your captured content; per the Local by default commitment above, the bytes stay on your machine, and there is nothing the maintainers can discontinue that would cause you to lose access to your captures. Even if Khiip's maintainers cease active development of the daemon, the AGPL-3.0 LICENSE permits the project to continue under the community; the GitHub repository, release artifacts, and source code remain available subject to GitHub's own continuation.
If Khiip's maintainers introduce hosted services in the future that hold user data, at least 180 days' public notice will be given before any such service is discontinued, and full export functionality will remain available throughout that notice window.
Intellectual property
"Khiip" — the name and the visual mark — is used as an unregistered trademark of Khiip's maintainers; trademark applications are pending. You may reference the Khiip name in commentary, education, reviews, comparisons, and documentation in ordinary editorial use; you may not use the Khiip name or visual mark in a way that suggests Khiip endorses your product, service, or content unless that endorsement is documented and authorized.
The Khiip source code is licensed under the AGPL-3.0 license for the daemon and substrate, and the Apache-2.0 license for the SDKs. Those licenses, not these Terms, govern what you may do with the source code, the compiled software, and the documentation in the project repository.
The khiip.com website's text, layout, and visual design are the work of Khiip's maintainers, made available for the ordinary uses of a published marketing website (reading, linking, screenshotting, citing). Re-publication of substantial verbatim portions of website content as your own work is not permitted; ordinary quotation, commentary, and reference are.
Third-party services
khiip.com is hosted on Cloudflare Pages, uses Plausible Analytics for traffic measurement, and may use Buttondown for newsletter delivery if a newsletter is operating. If you purchase Khiip Plus, the transaction is handled by Polar acting as merchant of record. The Khiip source code, issue tracker, and contributor activity live on GitHub. Each of these is a third-party service with its own terms. When you interact with khiip.com, you may also be interacting with those services. The Privacy Policy describes which third-party services receive what information; the providers' own terms apply to the parts of your interaction that touch their infrastructure.
Disclaimers and limitation of liability
The Khiip software is provided under the AGPL-3.0 license "AS IS," without warranty of any kind. The AGPL-3.0 license sections 15 through 17 are the legally binding statement of this. The DISCLAIMER is the plain-language restatement of what that means for substrate behavior.
The khiip.com website is provided "as is" and "as available." Khiip's maintainers aim to keep the website functional and the information on it accurate but cannot guarantee uninterrupted availability, freedom from errors, or that the third-party services the website depends on will themselves be available at any given moment.
To the maximum extent permitted by the law applicable to your interaction, Khiip's maintainers are not liable for indirect, incidental, special, consequential, or exemplary damages arising from your use of the website. For damages arising from your use of the Khiip software, the AGPL-3.0 license's limitation of liability (sections 16 and 17) is the controlling statement.
Material changes
If these Terms change in a way that meaningfully expands obligations, restricts permitted use, or alters any of the commitments in the Our commitments section, Khiip's maintainers will announce the change at least 30 days before it takes effect. The notice will be posted on khiip.com and in the project repository's release notes. If a newsletter is operating at the time of the change, subscribers will receive the notice by email.
Smaller changes that clarify language, correct errors, or reflect updates to third-party providers' own terms may be made without advance notice. The Last updated date at the top of these Terms reflects the most recent revision, and the change history is visible in the git history of this file in the project repository.
If you do not agree with a material change, you can stop using the website before the change takes effect.

Khiip's maintainers aim to respond to inquiries within 14 days. Questions that require legal or technical investigation may take longer; the maintainers will acknowledge receipt within 14 days even if a substantive response takes more time.
